The United States government and Andrea Fischer, while at Fischer Legal Group‘s predecessor firm, settled a False Claims Act case against CVS/RX America. Ms. Fischer’s client, a senior citizen, alleged that RX America was billing more for certain drugs on its prescription plan than the amounts set forth by RX America on the Medicare website. As a result of RX America’s misrepresentation, the government was paying more for their medications than it should have, and senior citizens were being pushed into the donut hole, where they had to pay for their own medications, much sooner than anticipated. This case was the first Medicare Part D case brought and successfully resolved under the False Claims Act.
